We defend Workers' Compensation cases in New Jersey and Pennsylvania. Workers' Compensation is a "no fault" insurance program that provides benefits to employees who suffer job related injuries or illnesses.
In this decision, in which Mr. Kawczynski represented Verizon Pa., Inc. the Commonwealth Court of Pennsylvania denied the claimant's penalty petition. The Court held that the Workers' Compensation Judge properly held that Verizon did not violate the Workers' Compensation Act by paying simple (as opposed to compound) interest on an award which reinstated the claimant's benefits. The Court held that compound interest is only permitted when explicitly provided either statutorily or contractually, and neither applied given the facts on the record.
